Terms of purchase

General

The website www.shop-se.brainlit.com (the “Website“) is provided by Brainlit AB (“we“, “us” or “Brainlit“), Scheelevägen 34, 223 63 Lund, org.nr 556902-2014, VAT registrationummer SE556902201401.

These general terms and conditions (the “Terms“) apply to purchases  made on the Website. By visiting and/or placing an order on the Website, you accept and agree to the content of the Terms. Make sure you have read and understood the Terms and Conditions before placing your order.

We reserve the right to change the Terms without prior notice to you, by posting new Terms and Conditions on the Website. The version of the Terms and Conditions that apply to your order is the version available on the Website when you place your order.

These Terms do not limit your statutory rights.  If you are granted more far-reaching rights by law than those set out in the Terms, you can always make use of your statutory rights.

Orders and payment

You must be at least 18 years of age to shop on the Website. When you place an order, you will receive an email confirming that we have received your order. The email only confirms that we have received your order and is not an acceptance of your order. The purchase agreement itself is concluded only when your payment has been approved and your order has been administered by us. We reserve the right not to accept your order, for whatever reason. We also reserve the right to cancel an approved order if the item you have ordered is not in stock, your invoice details are incorrect, we cannot deliver to the specified delivery address, there has been an incorrect price for the item on the Website, we have reason to suspect fraud, you are under 18 years of age, or as a result of Force Majeure event (see below).

If we refuse or cancel your order, we will contact you and, if possible, do our best to find an alternative solution.

You have the right to cancel your order until it has been packed and shipped. If you change your mind or want to cancel your order for any reason, please contact our customer service and have your order number availablet.

We offer secure payment through the payment solutions provided from time to time by Klarna and card providers.  Brainlit never has access to the payment details you provide (e.g. card information). Please note that Klarna applies its own terms and conditions for the payment, which you can find here.

Prices and VAT

All prices on the Website are inclusive of value added tax (VAT) and excluding any delivery costs.

We reserve the right to change the prices on the Website without prior notice.

Delivery

Shipping cost is added with SEK 595 for purchases up to  SEK 35,000. For purchases between SEK  35,000 and SEK 55,000, the shipping cost is SEK 995. For purchases over SEK 55,000, it is free of charge. Please note that we only deliver to addresses in Sweden.

Orders placed on the Website are sent from Brainlits lager in Lund with DHL.  We ship orders every business day and try to deliver your order as quickly as possible. Normal delivery time is 2-5 working days from the time you have received your order confirmation. To avoid delivery delays, make sure you enter accurate shipping information. Right of withdrawal

As a consumer (not for business), you have a statutory right of withdrawal which means that you have the right to withdraw from the contract (i.e. a purchase you have made on the Website) without giving any reason within 14 days. The withdrawal period expires 14 days after the day on which you or any third party, other than the carrier, you specify, takes physical possession of the goods (if your order is delivered in separate shipments, the time limit is calculated from the day on which you or any third party, but not the carrier, as you specify, takes  physical possession of the last shipment).

If you wish to exercise the right of withdrawal, please send us a clear and unambiguous notice of your decision to withdraw from the contract (e.g. a letter sent by post or e-mail).

In order for you to be able to exercise your right of withdrawal in time, it is enough that you send in your message that you intend to exercise the right of withdrawal before the withdrawal period has expired.

If you withdraw from this agreement, we will refund all payments we received from you, including delivery costs (but then extra delivery costs as a result of choosing any other mode of delivery than the cheapest standard delivery we offer) are not counted. The refund will be made without undue delay and in any case no later than 14 days from the day on which we were notified of your decision to withdraw from the contract. We will use the same means of payment for the refund as you yourself have used for the initial business event, unless you have expressly agreed otherwise with us. In any case, the refund will not cost you anything. We may delay the refund until we have received the item back from you or until you have submitted proof that you have returned the item, whichever comes first.

You must return the goods to us without undue delay and in any case no later than 14 days after the day on which you notified us of your decision to withdraw from the contract. The withdrawal period shall be deemed to have been complied with if you send the goods back before the expiry of this fourteen-day period.

You pay for the direct costs of returning the goods yourself.

You are responsible only for the reduced value of the goods as a result of handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exchanges

If you want to exchange the item you ordered for another product, you need to regret your purchase and order a new item in accordance with your wishes. You can also contact our customer service and we will help you.

Complaints

You have the right to return an item that, when delivered, is faulty or does not match your order. If you receive a faulty item, you need to contact us and give us notice of the error as soon as possible, but no later than within two months of noticing (or should have noticed) the error.

Brainlit is responsible for errors that exist at the time of delivery and that you complain to us within three years (two years for companies) from the time the product was handed over. A defect which appears within six months of the delivery of the goods shall be deemed to have existed at the time of delivery, unless otherwise shown or this is incompatible with the nature of the goods or defects.

If you return an item that you deem to be defective, we will examine the item and – if we agree that the item is faulty – either repair, replace or refund the item to you, according to our preference.

Please contact our customer service if you want to complain about an item.

Force Majeure

Brainlit shall not be liable for any failure or delay in the fulfilment of its obligations if such delay or omission is caused by an event beyond our reasonable control, including but not limited to flood, fire, earthquake, strike or other labor dispute, accident, epidemic, pandemic, war or war event, civil unrest, riot, occurred or feared terrorist attack or government decision or regulation (“ Force Majeure Event“).

We will contact you in the event of a Force Majeure event that affects our ability to fulfill our obligations to you. If your delivery of goods is affected by the Force Majeure event, we will rebook the delivery to a date as soon as possible after the Force Majeure event has ended. Alternatively, you can cancel the purchase by leaving us notice of it.

Applicable Law

These Terms, and purchases made on the Website, are governed by Swedish law.

Dispute Resolution

If you think that an item you have bought from us is faulty but we do not agree with you, you can also turn to the Swedish National Board for Consumer Complaints, Box 174, 101 23 Stockholm, www.arn.se.  We participate in the dispute resolution process and follow ARN’s recommendations.  The competent court  that brings an action against Brainlit is malmö District Court of first instance.
